MaxPoint Interactive, Inc. (“MAXPOINT,” “we,” “us,” “our”) is a provider of targeted interactive advertising technology and services to websites and online marketers, and considers the protection of your privacy to be of paramount importance. This Privacy Policy was prepared to describe how we use and collect consumer data that we collect when users access websites or mobile applications that use our services (our “Business Partners”), or that third parties share with us. This Privacy Policy does not apply to practices of third parties that we do not own or control. You should review the privacy policies of all websites you visit and mobile applications you use.
Network Advertising Initiative and Opt-Out
MAXPOINT is a member of the Network Advertising Initiative. You can visit the NAI’s Web Site to learn more about network advertising, and to opt out of having any or all NAI- members collect non-personally identifiable information about you for use in targeted advertising. When you opt-out using either of these methods, we will place an opt-out cookie on your browser. This means that we will no longer collect non-personally identifiable information about you, though we may continue to serve you default (i.e., non-targeted) ads. Opt-out cookies expire after 6 years. You should note that if you delete, block or otherwise restrict cookies, you may need to renew your opt-out choice. Also, please be aware that when you opt out, your opt-out cookie will only be effective as to the computer AND BROWSER or device AND BROWSER that you opted out from; you must opt out for each computer or device you use individually.
Data Collection and Usage
Personal Information
“Personal information” is data about you that personally identifies you as an individual, like your name, street address, email address, or phone number. MAXPOINT never uses, collects or keeps personal information about people who interact with any of the sites in the network, except as provided below with respect to direct requests. Prospective customers can go to the www.MAXPOINT.com site and provide their contact information to us, to find out more about MAXPOINT and to be contacted by a MAXPOINT representative. MAXPOINT (and its agents and service providers) may use this information to respond to your request, and for business purposes such as marketing and research. We will not rent or sell this information to other companies.
Non-Personal Information
When you are using our Business Partners’ services, we collect certain non-personal information about you (using various technologies, including cookies, as described in more detail below), including but not limited to your browser type (for example, Internet Explorer or Mozilla), your IP address, and your operating system (for example, Windows or Macintosh). In addition, we collect information about your browsing behavior, such as the date and time you visit the Business Partners’ websites, pages of such websites that you visit, and other click-stream data such as page visits, ads shown, and ads clicked, none of which will include personal information about you.
MAXPOINT may also receive non-personal, aggregate information from other sources; for example, we might receive data from a third party that indicates a particular interest in a geographic area a certain model of car is popular in a particular area, and therefore people located in that general area might be interested in an ad for similar cars. We combine this information with the information we collect through our Business Partners, but never in a manner that would personally identify you as an individual.
MAXPOINT does not collect or use any health-related data that personally identifies you, but MAXPOINT may use certain health-related information (for example, aggregated data about the number of allergy sufferers in a particular geographic area) in delivering advertisements. This may include, without limitation, utilization of the following health-related data segments: Men’s Health and Wellness, Women’s Health and Wellness, General Health, Seniors Health and Wellness, and Common Ailments and Illnesses.
Use of Non-Personal Information
In order to serve you targeted advertisements, MAXPOINT will assemble non-personally identifiable, demographic, behavioral and technical information about you and others like you to create very large visitor “clusters.” These clusters represent data that has been aggregated into large anonymous groupings, but that our assembled data suggests may have similar needs or interests. To ensure that the online marketing targeting services provided by MAXPOINT are targeted correctly, Business Partners’ websites place MAXPOINT’s data tags on their sites. These tags do not collect personal information. They are used to match visitor browsing behavior to a cluster profile, in order to serve you an advertisement you may be interested in.
As a general matter, MAXPOINT may use your non-personal information to improve its products and services, in order to optimize your online experience.
Cookies
Nearly all websites, including those of the Business Partners using MAXPOINT’s products and services, use a feature of your browser to set a “cookie” on your computer. Cookies are small packets of data stored on your computer. The site placing the packet on your computer can then recognize the computer when you revisit the site. The site’s computer uses the cookie to provide services such as auto log on and relevant ad delivery, and to better understand how you are interacting with the site. These cookies effectively enable sites to better customize the site to your needs and interests, so that it can be as valuable to you as possible.
Your browser may offer you the option of declining cookies, but by doing so you may not be able to use certain features on the websites or take full advantage of all the website offerings and targeted advertising. You may be able to configure your browser to accept all cookies, reject all cookies, erase cookies, or notify you when a cookie is set. (Each browser is different, so check the ”Help” menu of your browser to learn how to change your cookie preferences.) Please note that if you do not accept cookies, you will not be able to set an opt-out cookie as described above.
Disclosure of Information
Non-personal information may be transferred or disclosed to our Business Partners in aggregated form (i.e., a collection of information relating to multiple users that does not identify you or any other individual personally), to segment and target relevant advertisements to you and to help our Business Partners optimize their services.
Non-personal information and the limited personal information we collect may be transferred or disclosed for the following purposes: (1) to our agents and personnel, to enable any of these people or entities to perform a business, professional or technical support function for us; (2) when we believe in good faith that such disclosure is necessary to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law or to enforce or apply our agreements with third parties and to protect the rights, property, or safety of MAXPOINT, its employees, customers, and agents; and (3) in connection with the sale or acquisition of MAXPOINT to another entity.
Data Retention
Non-personal information linked to a browser is kept for a period of one year after it is collected. After that period has expired, the non-personal information is de-linked from any browser identifier, but may be kept for research and used as set forth in this Privacy Policy.
Social Media
On our Twitter account and on our OnPoint blog, we encourage our followers and readers to participate in our conversation and we welcome your thoughts and comments. While we will do our best to reply to all comments, @mentions, retweets and direct messages (DMs), we will not reply to anything off topic, including personal attacks and foul language. MAXPOINT is not responsible for anything expressed on personal MAXPOINT employee accounts as they do not necessarily represent the views of the company.
Children
MAXPOINT believes that it is especially important to protect children’s privacy online. MAXPOINT does not knowingly collect or use any personally identifiable information from children under the age of 13. No information should be submitted to or posted at www.maxpoint.com by visitors younger than 13 years old. If you believe we have collected personally identifiable information about a child under 13, please notify us immediately at privacy@maxpoint.com.
Security
We take industry-standard security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. This includes physical, electronic and managerial procedures to protect data integrity, access and use.
